Yesterday, I had completed reading the book "reproductive medicine and life ethics".

大変、面白かったので、一部紹介致します。

I was interested in the contents and I want to introduce a part of the book to you.

体外受精 ―― いわゆる「試験管ベビー」―― では、細胞分裂後の胚(受精卵)を子宮に戻して使います。

In the case of "In vitro fertilization (IVF)" that called "baby born through in vitro fertilization", one of the embryos after cell division is returned to uterus.

「分裂する」ということは、「複数個ある」ということで、「複数個ある」ということは、「いくつかは余る」ということです。

"Cell division" means a number of embryos, and "a number of embryos" means "existing some of the unnecessary cell"

―― その「余った受精卵」をどうする?

One problem is

"How do you handle the unnecessary cells?"

という問題があるのです。

■そんなもん、廃棄するくらいなら、実験研究に使えるに決っているだろうが ―― を基本とする、アメリカの法律

- The U.S law says that "possible to reuse them for R&D naturally if throwing away"

■人間の基本となる受精卵を、実験なんぞに使える訳ないだろうが ―― を基本とする、ドイツの法律

- The German law says that "impossible to use them, because of a basic of the human"

と、各国によって、考え方が真逆なのですね。

Both laws say the exact opposite.

ちなみに日本では、「どうしよう~~?」と揺れている感じ(に、私が感じました)。

I think that Japanese law seems to be annoying the big issue.

ここに一つのジレンマがあります。

This is one dilemma.

「ドイツだって、妊娠中絶を認めているじゃないか。つまり、受精卵は人権を有しないと、自ら認めているのだろう?」

German law allows abortion. That means that German law admit that embryos does not have a human rights

これに対して、ドイツは、「緊急避難」の理論を用います。

Against the logic, the German laws use the theory of "emergency evacuation",

緊急避難とは、

whose typical example is

『海上で遭難した時に、自分と他人が木片に掴まった時、自分が助かる為に、他人から木片を奪いとって、結果として殺しても、罪に問われない』

When you are in distress at sea and the other and you had caught in a piece of wood, you are not guilty even if you commandeer the wood and kill the other."

というものです。

ドイツ法は、

The German law says the following,

■「妊娠中絶というのは、子どもを育てる能力のない者の、時間の迫った危機に対する緊急避難である」

"Abortion is a kind of "emergency evacuation" in order to save the people who don’t have a capability of child care in a crisis of the forthcoming time"

■「比して、受精卵を使った実験なんぞに、このような『緊急避難』に相当する、正当性があるか?」

"In comparison, can any R&D have the justice like this "emergency evacuation"?"

と言います。

―― なるほどなぁ。

Hmmm.

説得力のある理論ですよね。

It is a persuasive theory isn't it?

私は、「倫理」とか「常識」とかいう言葉に、身構えてしまう方ですし、また、ドイツの対応に全面的に賛成という訳ではないですが、こういう倫理の論理展開を読むと、とても嬉しい気持ちになります。

I would defensively to words like "ethics" and "common sense" and I don't agree fully with the legislative intent of the German law. But I feel very happy with reading the logical deployment of such ethics.
