2013-07-20 「さっさと『9条』を改正すればいいのよ」と、あの娘が言った日 (前編)

私が学生だったころ(25年くらい前)、法律を勉強していた友人が、

「さっさと『9条』を改正すればいいのよ」

と言って、私の度肝を抜かせたことがあります。

当時の私は、大学の自治寮の寮長であり、思想的には「左」で、自動的(?)に『9条』に関しては「護憲」の立場であったと思います。

その私に正面切って「9条改正」を言い切ったのは、後にも先にも彼女だけでした。

まあ、私のスタンスを「全然知らなかった」だけかもしれませんが。

日本国憲法第9条は、前文と併わせて、我が国の憲法の三大原則の一つである「平和主義」を規定しているものです。

■第1項 日本国民は、正義と秩序を基調とする国際平和を誠実に希求し、国権の発動たる戦争と、武力による威嚇又は武力の行使は、国際紛争を解決する手段としては、永久にこれを放棄する。

■第2項 前項の目的を達するため、陸海空軍その他の戦力は、これを保持しない。国の交戦権は、これを認めない。

彼女が言っていた「9条」とは、正確には「第9条2項」の、いわゆる「戦力不保持」を示しています。

「自衛隊の存在との不整合」が発生することに対する、法律を勉強する学生としての、一種のストレスだったんだろうなぁ、と今では思えます。

なお、この当時、まだ、「自衛隊を海外に派遣する」などという観念すら存在していなかったことに、留意しておいて下さい。

現在、この「日本国憲法第9条2項」は、沢山のバンドエイドやら、包帯やらを巻きつけながら、ゼーゼーいいながら、なんとか存在している、という感じがします。

というのは、この9条2項は、どう考えても「そりゃ、ちょっと無理があるのではないか」という解釈論で逃げまくってきたからです。

いろいろな解釈があるのですが、一番有名な政府解釈を、私なりに書き下してみると、こんな感じでしょうか。

■第1項では、(1)国際紛争解決としての戦争は「ダメ」だけど、(2)自衛戦争は「ダメ」とは言っていないよね。

■第2項にいう「交戦権」とは、(1)のことを言い、(2)の自衛戦争を含まない、と読めるよね。

■だから、自衛隊の存在は「合憲」だよね。

私が思うに ―― 多分、法律家も政治家も、これを日本人であれ外国人であれ、こんな話を、その人たちに説明するのが、本当に面倒くさいんだろーな、と思うのです。

私も最近、法律(といっても特許法ですけど)の勉強を開始して、この気持が分かるようになりました。

「解釈(定説、反対説、その他)を2つ以上覚えるのは面倒なんだよ」

「私の脳のキャパはそんなに大きくないんだから、とっとと成文化してくれよ。本当に勘弁してくれよ」

と、泣きたくなることがあります。

まあ、特許法などの知的財産権法は、2年おきにくらいにコロコロと変わりますので、別の意味で泣きたくなることもありますが。

それはさておき。

憲法はその国の法律の最高法規ですから、この憲法に「逆らわないように」それ以外の法律が作られることになります。

その最高法規に「逆らうような」もの(例:自衛隊等)を運用している、という状態は、

多分、我が国の最高意思決定機関の長の人達にとって、

『これ以上もなく、気持の悪い状態』

ということは、想像に難くありません

私のような、知財法の初学の下っ端でも、法解釈では「イライラ」させられるくらいなのです。

そのような方々にとって、9条2項の改正というのが「悲願」というのは、本当によく理解できるのです。

2014-07-20 自動車で歩行者に突っ込んで、死傷させていたのは、私だったかもしれません。

昨日まで、3日に渡って、「脱法ドラッグ」について書いてきたのですが、

実は、私、今年の3月くらいに、コラム執筆の為に、「脱法ドラッグ」を実際に購入、使用してみようかと思っていたことがあるのです。

To tell you the truth, I had really intended to purchase and use the "evasion of the law drug" for writing my columns.

「『脱法ドラッグ = 合法ドラッグ』なのだから、飲酒運転よりもずっと安全で、タバコ程度のものなのだろう」という、馬鹿げた勘違いをしていた為です。

I did ridiculous misunderstanding that they are safer than smoking or drinking drive because "evasion of the law drug" is a legal material.

繰り返しますが、脱法ドラッグとは、違法認定直前の「正真正銘の麻薬・覚醒剤」です。

It is repeated, but the "evasion of the law drug "is a true drug just before the illegal authorization.

自動車で歩行者に突っ込んで、死傷させていたのは、私だったかもしれません。

2015-07-20 先日も、凄い仮説 ―― というか、あれはもう論文といっても良い ―― ものを送ってして頂き、驚いてしまいました。

The other day, I was pleased to be given a great hypothesis from a reader that really surprised me. It is not just a hypothesis but also almost a thesis.

来月のコラムは、きっと楽しい執筆になる ―― と、いいな、と思っています。

The column of next month is surely going to make me fun, I hope.

私のコラムは、長いし、理屈(ロジック)が面倒だし、数字多いし、「読むことが苦痛ですらある」という人はかなりの数いると思うのです。

My columns are long, troublesome arguments (logic), and many numbers, so some persons might feel "reading itself is considerable painful".

なにしろ、その内容は、理屈と数値だけに依拠し「血も涙もなく」なく、直感にも反する内容が多いです(『強い決意表明が決意を挫く』とか)

Anyway the contents depend on only reason and numerical value. and so called "cold-blooded". And in addition, some columns are against intuition (for example "a strong determination expression is going to destroy determination itself").

一説には、文章の中に数式が一行入るだけで、読者の半分が、そこで読むことを断念する、という話もあるくらいです。

There is a story that half of reader gives up reading when they face a sentence containing a numerical formula.

データ、解析結果、推論等でも、あまりウケは良くないように感じます。

Even if it not formula, I am afraid that many readers don't like data, analysis result, the reasoning either.

その割に、この「数字シリーズ」は、結構面倒なんです。

This "number series" is quite troublesome against my efforts.

データの収集だけで、一時は、体を壊しそうになったことすらあります。

Only by the collection of data, I had almost damaged my health at one time.

ですので、このように、読者の方から、仮説を送付して頂けますと、大変元気が出てきたりするのです。

So, the gift like this great hypothesis from a reader will cherry me up.


2016-07-20 ―― 早く借金返して、ラクになりたい

私が利用させて頂いている小田急は、海外の観光客の方もよく利用されているようです。

Odakyuu-Dentetsu, I use everyday as a commuter, is also used by non-Japanese tourists.

小田急の下り方面は、「小田原」と「江ノ島」の2つの目的地があり、それぞれ「箱根」と「鎌倉」の中継点になっています。

There are two terminal station of Odakyu down line, "Odawara" and "Enosima". and the two stations are rely points toward "Hakone" and "Kamakura".

つまり、海外の観光客の人にとって、小田原線と江ノ島線を間違える可能性が結構高いことが推測され、実際にそのようです。

In short, for non-Japanese tourists. it might be high possibility to wrong Odawara-line and Enoshima-line, some person did it so.

今も、私の隣りに座っているのは、中国から観光に来られた方のようです。

The persons next me seat are likely to be tourists from China.

スマホを眺めながら、電車の中で困っている様子を見ていると、声をかけたくなります。

When they watch their smartphone and seems to be in trouble on a train, I will want to say something.

これは、私が親切だからでは断じてなく、私が、これまで数限りなく、海外で助けて貰ったという「負債感」がそうさせるのです。

The reason why I want is that I am never kind, but I have "debt feeling" while having been helped by many people overseas.

つまり、

In conclusion, it means,

―― 早く借金返して、ラクになりたい

"I want to be easier as soon as returning my debt early"

です。

明らかに英語を使っている、あるいは、欧州から来られたと思う人については、英語でしゃべりかけますが、通じるようです。

It might be no problem when they are English native speaker, or European people. In most cases, I can use English.

アジアの人も、若い人なら、英語でしゃべりかけてみます。こっちも概ね大丈夫です。

Even Asian young people are also O.K. about English.

問題は、明らかに中国語やハングル、または他の東南アジア系の言語をしゃべっていると思われる、中年以上の世代です。

My objective is to help senior tourists seems to speak Chinese, Hangul or other Southeast languages.

The both feelings are coexisting, and involved complicatedly.

Ebata: "I have worked with people in so many countries, China, Korea, Taiwan, Thailand, India... and I have got a lot of help from them.

次女:「それで?」

JD:"And ?"

江端:「もし、私が、ある特定国の人を侮辱するようなヘイトなメッセージを発信したら、その人達は、どう感じるだろう、と考えるだけで、怖いよ」

Ebata:"If I send a hate message that insults the people in a certain country, how do them feel about me ? Just thinking that, I'm scared. "

次女:「どう感じると思う?」

JD:" How do you think "how they think about you"?"

江端:「逆の立場で考えてみれば分かりやすいと思う。多分、「怒る」より先に「悲しい」と感じると思う。一生懸命、一緒に働いてきた日々が、全部台無しにされることになる訳だから」

2020-07-20 ―― 「発明」は難しくない。本当に難しいのは「その発明を必要とする課題」を見つけ出すことである

最近、発明のアイデアを創成する為に、ブレーンストーミング(BS)を頻繁に参加しています。

Lately, I've been participating in frequent brainstorming (BS) sessions to create ideas for inventions.

発明創成に関しては、BSの最中に「否定的なコメントをしてはならない」という暗黙のルールがあります。

When it comes to invention creation, there is an unspoken rule of "no negative comments" in the middle of the BS.

その理由の一つとしては、発明を創成する為には、現状の社会常識のパラダイムの「破壊」が前提となるからです。

One of the reasons is that in order to create an invention, "destruction" of the current paradigm of common sense is a prerequisite.

簡単に言えば、

Simply, it is

■「非常識」が常態となった世界のイメージ創成

"Creating an image of the world where "insane" is the norm"

であり、もっと簡単に言えば、

more simply, it is

■「異世界」の構築

"Creating 'another world'"

です。

最近分かってきたのですが、他の人と比べて、私は、この『「異世界」の構築』が、比較的「得意」なようです。

私は、「ぶっとんだ世界」を考えることが好きです。

I like to think of the "insane world".

(2)日本の観測点の半分以上の最高気温が40度を越えと日々が20日ぶっつづけで続く世界 → 一日、千人~万人のオーダで発生する熱射病患者を、医療設備以外の手段でどうやって治療するか?

(2) More than half of the stations in Japan have a maximum temperature of over 40 degrees Celsius for 20 straight days → How do we treat tens of thousands of heatstroke patients a day, in tens of thousands of orders, by means other than medical equipment?

(3)特殊出生率が0.5までに下った世界 → 子どもの存在が珍しい世界における、子どもの育成方法や教育方法は?

(3) A world where the fertility rate has fallen to 0.5 → What are the methods of raising and educating children in a world where the existence of children is rare?

とまあ、こんな風に、極端な世界を考えることで、「課題」が出てきます。

And, well, thinking about the world of extremes in this way helps us to see the "challenges".

でもって、こちらでも述べていますが、

"Invention" is not hard. What is really hard is to find the "problem that requires the invention".

というのは本当です。

2021-07-20 『(ワクチン接種を完了した)高齢者が、(接種をしていない)グッタリしている若者を抱えて、病院を奔走する』

昨日、会社を休んで、新型コロナウイルス対応のワクチン接種(2回目)をしてきました。

Yesterday, I took a break from work and vaccinated against the new coronavirus (second time).

ワクチンの効果は、まだ先(2週間後?)になるそうですし、また、ワクチン接種をすることで発病や重篤化は、確率的に低くなるものの、完全ではありませんし、

I heard that the vaccine will not be effective for a long time (2 weeks?). In addition, although the vaccination reduces the probability of illness and seriousness, it is not perfect.

なにより ―― 私が、ウイルスの運び屋(キャリア)にならないという保証はありません。

Above all -- there is no guarantee that I will not become a carrier of the virus.

ある研究報告では、『変異株(デルタ株)のキャリアは、ワクチン接種の完了者である』という説もあるほどです。

One research report even states that 'carriers of the mutant strain (delta strain) are completers of the vaccination'.

当然のことですが、誰でもワクチン接種を拒否する権利があります。

実際に、接種後に「副反応」は現われます。

I think it's a bit too much to ask for 'no damage, just do something' when the body is in the process of producing antibodies to fight the worst virus in human history.

今後、このウイルスは「ワクチン接種をしない人間を直接襲ってくる」ように変異し続けると思います。

I believe that this virus will continue to mutate to "attack unvaccinated humans directly" in the future.

どんなウイルスだって、生き残るのに必死です。

Any virus is struggling to survive.

その為に、ウイルスへの抗体を持っていない世代の人間を狙ってくるのは当然です。

Therefore, it is natural for them to target the generation of people who do not have antibodies to the virus.

例えば、10~20代の接種率が低ければ、10~20代に感染しやすいように変異するはずです。

加えて、国内のワクチン接種率が高くなればなるほど、その困難を乗り越える為に、さらに強毒化(高い感染力と殺傷力)してくるはずです。

一週間ほど前、コンビニで、表紙に「いまだにマスクをしているバカ」と書いた週刊誌を見ました。
