法治国家では事後法・遡及法は許されません。

事後法・遡及法というのは、後に法律を作って、遡って罰を加えることです。

とまあ、わざわざ「法治国家」の話を出さなくとも、現在の判断基準をもってきて、過去の事件を判断するのは「理不尽」です。
